BAYSE General Terms & Conditions

These Terms & Conditions govern all BAYSE memberships, and credit packs.

By subscribing or purchasing, you agree to the following terms.

1. Contract Term for Memberships

BAYSE memberships operate on either a rolling 28-day, 6-month, or 12-month term, depending on the membership you select.

All memberships renew automatically at the end of each 28-day billing period unless cancelled in accordance with these Terms.

2. Billing & Payments for Memberships 

Payments are billed every 4 weeks (28 days) from your membership start date.

Because payments are every 28 days, some months may include two payments — this is normal and due to month length differences.

Payments are collected automatically via your chosen payment method.

By subscribing, you authorise BAYSE to collect recurring payments automatically.

You agree not to dispute legitimate charges that comply with these Terms.

3. Cancellation Policy for Memberships

You must provide 28 days’ notice before the end of your current term to cancel your membership.

Example: If your next billing date is May 10, you must cancel by April 12 to avoid renewal.

All cancellation requests must be made via your BAYSE client area (My Account).

Notice given by email, text, social media, or phone will not be accepted.

Cancellations are only valid once submitted correctly through your client area.

No refunds are provided for early termination, missed sessions, or unused credits.

4. Pausing Membership for Memberships

You may pause your membership once per calendar year for up to one month (28 days).

Pause requests must be made via your BAYSE client area (My Account) — emails, texts, or social media messages are not accepted.

Pauses are permitted for valid reasons such as holidays or illness.

You may continue to use any existing credits during a pause.

Additional pause requests may be considered in exceptional circumstances at BAYSE’s discretion.

Members on founders’ or discounted rates will lose their discount if they pause their membership.

5. Credits: Allocation & Usage

Credits are automatically added to your account with each 28-day payment.

Carry-over allowed: unused credits roll over into the next billing cycle while your membership is active.

Credits can only be used while your membership is active and will expire immediately upon cancellation or payment failure.

Credits are personal, non-transferable, and non-refundable.

Credit pack expiry:

  • 1 Credit – valid for 7 days from purchase.
  • 3 Credit Pack – valid for 21 days from purchase.
  • 6 Credit Pack – valid for 42 days from purchase.

6. Booking & Class Cancellations

  • Cancel a class 12 or more hours before → credit refunded.
  • Cancel under 12 hours before → credit not refunded.
  • No-show → credit not refunded + £10 no-show fee charged immediately.

7. Class Cover & Studio Policy

If BAYSE cannot secure instructor cover for a class at least 24 hours in advance, the class will be cancelled.

  • Your credit will be refunded, and
  • An additional free credit may be added as a courtesy.

Requests for instructor cover (for franchise or staff use) must be made with at least 4 weeks’ notice.

8. Behaviour & Code of Conduct

Members must behave respectfully toward instructors, staff, and other members at all times.

Disruptive, unsafe, or abusive behaviour may result in suspension or termination of membership without refund.

9. Health & Safety

By subscribing, you confirm that you are fit and able to participate in exercise.

You are responsible for completing and updating your PAR-Q (Physical Activity Readiness Questionnaire) and notifying BAYSE of any health changes.

BAYSE is not liable for injuries that occur due to undeclared medical conditions, misuse of equipment, or failure to follow instructions.

10. Payment Failures

If a payment fails, BAYSE reserves the right to:

  • Retry payment automatically,
  • Suspend your account until the balance is cleared, and
  • Apply a £15 administration fee for failed or late payments.

Membership time continues to run during any suspension.

11. Refund Policy

All fees and payments are non-refundable, except where BAYSE cancels a class and cannot offer a suitable replacement instructor. In this instance your class credit will be refunded to your account and in certain circumstances additional credits maybe awarded.

Refunds will not be issued for unused credits, early termination, or missed sessions. 

Refunds relating to any system payment issue will be allocated on a case by case basis, please contact our business number for help.

12. Cooling-Off Period (for Online Sign-Ups)

If you purchase a membership online, you have a statutory 14-day cooling-off period.

If you book or attend a class within that time, you acknowledge that your membership begins immediately and the cooling-off right is waived.

13. Liability & Indemnity

You participate in all BAYSE activities at your own risk.

BAYSE is not liable for injury, loss, or damage except where caused by proven negligence.

You agree to indemnify BAYSE, its instructors, and staff against any claims or damages arising from your participation.

14. BAYSE’s Right to Refuse or Terminate Membership

BAYSE reserves the right to suspend or terminate memberships immediately and without refund if:

  • Payments are repeatedly missed,
  • Policies (e.g. no-shows or cancellations) are repeatedly breached, or
  • Behaviour is unsafe, abusive, or harmful to the BAYSE brand.

15. Changes to Schedule

Class timetables, instructors, or locations may change from time to time.

BAYSE will provide reasonable notice of changes where possible.

Schedule changes do not entitle members to a refund.

16. Data & Communication

Your personal data is handled in accordance with BAYSE’s Privacy Policy: www.baysefitness.com/privacy.

By subscribing, you consent to receive communications related to your membership (billing, cancellations, updates, etc.).

17. Force Majeure

BAYSE is not liable for failure to deliver services due to events outside its reasonable control, including but not limited to: government restrictions, pandemics, natural disasters, strikes, or facility closures.

In such cases, BAYSE may at its discretion freeze, extend, or adjust memberships without obligation to issue refunds.

18. Media & Intellectual Property

By attending BAYSE classes or events, you consent to being included in photos or videos used for marketing purposes.

Members who do not wish to appear must notify BAYSE in writing in advance.

All class content, training materials, and media produced by BAYSE remain the intellectual property of BAYSE and may not be copied or reproduced without permission.

19. Legal & Jurisdiction

These Terms are governed by the laws of England & Wales.

Any disputes shall be handled under the exclusive jurisdiction of the English courts.

By subscribing or purchasing, you confirm that you have read, understood, and agree to these BAYSE Terms & Conditions.
